Terms of Service & Health Waiver

1.Acceptance of these Terms

By subscribing to Zoe Howse Breathwork ("the Practice", "we", "us", "our") — including the Wednesday Live Membership and any in-person events — you agree to these Terms of Service. If you do not agree, please do not subscribe or participate.

You confirm you are at least 18 years of age and have the legal capacity to enter into this agreement.

2.Membership & billing

The Wednesday Live Membership is AUD $40 per month, billed monthly to the payment method you provide. Your subscription gives you access to:

Subscriptions auto-renew on the same day each month until cancelled. Payment is processed securely via Stripe (or our nominated payment processor). We do not store your card details.

3.Refunds & cancellation

You may cancel your subscription at any time from your member portal or by emailing us. Cancellation takes effect at the end of the current billing period — you keep access until then.

No refunds for missed sessions. Sessions are live and run on a fixed schedule. Missed sessions do not roll over and are not refundable. To stop being charged for future months, cancel your subscription before the next billing date.

Refunds may be considered in genuinely exceptional circumstances (e.g. duplicate billing, technical failure on our side that prevented you from accessing any session in a billing period). Email hello@zoehowse.com.au within 14 days of the relevant charge.

This policy does not exclude any guarantees or rights you have under the Australian Consumer Law that cannot be excluded.

4.Health disclaimer & not medical advice

Breathwork is a complementary wellness practice. It is not a substitute for medical, psychiatric, or psychological treatment.

Zoe Howse is a Breathwork Coach, Consciousness Coach, Yoga Teacher, and former Registered Nurse. She is not currently practising as a medical doctor, registered nurse, psychiatrist, psychologist, or licensed therapist for the purposes of this service. Nothing said during a session — whether live or recorded — constitutes medical, psychological, financial, or legal advice.

Always consult your treating doctor before participating if you have any medical condition, are taking prescription medication, or are unsure whether breathwork is suitable for you. Continue any treatment prescribed by your medical professionals.

5.Contraindications — who should NOT participate

Breathwork involves intentional changes to your breathing pattern, which can cause measurable physiological changes (CO₂/O₂ levels, heart rate, blood pressure). It is not safe for everyone.

If any of these apply to you, please do not subscribe. If you develop any of these conditions while subscribed, cancel immediately and consult your doctor before resuming.

6.Voluntary participation & assumption of risk

Your participation in any Zoe Howse Breathwork session is entirely voluntary. You acknowledge that breathwork can produce a range of physical, emotional, and psychological responses, including (but not limited to):

You assume full responsibility for your physical, mental, and emotional wellbeing during and after each session. You may pause, slow, or stop any technique at any time. If you feel unwell, return to slow nasal breathing immediately.

You agree to ensure you are in a safe physical environment for the duration of the session — lying or sitting comfortably, not driving, not operating machinery, with no risk of falling or hurting yourself.

7.Release of liability & indemnity

To the maximum extent permitted by Australian law, you release, waive, and hold harmless Zoe Howse, her assistants, contractors, co-facilitators, and affiliates (the "Released Parties") from any and all claims, demands, losses, costs, damages, expenses, illnesses, or injuries — physical, mental, or emotional — arising from or in any way connected to your participation in any Zoe Howse Breathwork session, whether live, recorded, or otherwise.

You agree to indemnify the Released Parties against any third-party claims arising from your participation.

This release does not exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or any other applicable law.

8.Recording & content policy

Sessions may be recorded for member access, training, or marketing purposes. By participating with your camera or microphone on, you consent to being recorded and to your image and voice being used in member or marketing materials.

If you do not wish to appear in recordings:

You may not record, screen-capture, livestream, or redistribute any Zoe Howse session content (live or recorded) without written consent.

9.Intellectual property

All content provided by Zoe Howse — including audio, video, written materials, breathwork sequences, meditations, methods, and branding — is the intellectual property of Zoe Howse. Your subscription gives you a personal, non-transferable, non-exclusive licence to use this content for your own personal practice.

You may not teach, reproduce, sell, or commercially distribute any of this content without written permission from Zoe.

10.Privacy & data

We collect only the information necessary to provide the service:

We do not sell, rent, or trade your personal information. Email is used to send session reminders, member updates, and occasional announcements. You can unsubscribe from marketing emails at any time without affecting your subscription.

11.Code of conduct

Zoe Howse Breathwork is a respectful, inclusive, and trauma-aware space. By participating, you agree to:

Behaviour that is harassing, discriminatory, threatening, sexually inappropriate, or persistently disruptive will result in immediate removal from the session and cancellation of your subscription, without refund.

12.Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top of this page will reflect the most recent change. Material changes will be notified by email at least 14 days before they take effect. Continued use of the service after a change constitutes acceptance of the updated Terms.

13.Governing law

These Terms are governed by the laws of Victoria, Australia. Any dispute arising from these Terms or your use of the service will be resolved in the courts of Victoria.
